Terms of Service — Curvy Waist SA

These Terms of Service ("Terms") govern your access to and use of curvywaist.co.za (the "Site") and any purchase you make through it. Curvy Waist SA ("Curvy Waist SA," "we," "us," or "our") operates the Site, which is powered by Shopify. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Who We Are
Curvy Waist SA is based in Gqeberha, Eastern Cape, South Africa, and sells wigs, waist trainers, body shapers, shapewear, and other lifestyle products to customers across South Africa. You can reach us at support@curvywaist.co.za or +27 63 462 0361.
Eligibility
You must be 18 or older, or be using the Site with the involvement of a parent or legal guardian, to place an order. By ordering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into a binding contract.
Products
We sell physical products (including wigs, waist trainers, body shapers, and other shapewear and lifestyle items) and digital products (including the Copy My Store ebook and its Mentorship add-on). We describe every product as accurately as possible, including materials, color, length, and sizing. Actual color may vary slightly depending on your screen. We reserve the right to limit quantities, discontinue a product, or correct a product description or price at any time before an order is confirmed.
Product Use & Safety (Shapewear)
Our waist trainers and body shapers are compression garments, not medical devices. Follow the sizing and wear-time guidance on the product page. Stop wearing the product and consult a doctor if you experience pain, numbness, or difficulty breathing. If you are pregnant, recovering from surgery, or have an existing health condition, speak to a healthcare provider before use. Results from any shapewear product vary from person to person.
Pricing & Payment
All prices are listed in South African Rand (ZAR) and include or exclude VAT as stated at checkout. Payments are processed securely through Yoco. We take reasonable care to ensure prices are correct, but if a pricing error occurs, we will contact you before processing your order and give you the option to confirm at the correct price or cancel for a full refund.
Orders
Placing an order is an offer to buy, which we may accept or decline. We may cancel or refuse any order — for example, where a product is out of stock, we suspect fraud or unauthorized payment use, or a pricing/listing error is discovered — and will notify you and refund any payment already taken.
Shipping & Delivery
Shipping timeframes and costs are set out in our Shipping Policy. Delivery dates are estimates, not guarantees, and we're not liable for delays caused by our couriers or events outside our control.
Returns, Exchanges & Refunds
Returns, exchanges, and refunds for physical products are governed by our Refund Policy. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 ("CPA"), including your right to return defective goods.
Digital Products
Digital products, including Copy My Store and its Mentorship add-on, are delivered electronically and immediately upon successful payment. Because delivery is instant and the content cannot be "returned," these purchases are final once the download link has been issued — see our Refund Policy for the full digital-products terms. Purchasing a digital product grants you a personal, non-transferable license to use it for your own business. You may not resell, redistribute, publicly share, or repackage the content, in whole or in part, without our written permission.
Intellectual Property
All content on the Site — including text, graphics, logos, product photography, and the Curvy Waist SA name and @curvywaistsa handle — is owned by or licensed to Curvy Waist SA and protected by South African and international law. You may not copy, reproduce, or use it commercially without our written permission.
Reviews & User Content
If you submit a review, photo, or other content to us, you confirm it's honest and your own, and you grant Curvy Waist SA a non-exclusive, royalty-free license to display and use it on the Site and in our marketing. We may remove content that is false, abusive, or violates these Terms.
Prohibited Uses
You agree not to use the Site to: violate any law; infringe our or a third party's intellectual property; transmit malware or attempt unauthorized access to our systems; scrape or resell our content or pricing; or interfere with the Site's normal operation.
Third-Party Services
The Site relies on third-party providers, including Shopify (platform), Yoco (payments), and Aramex (delivery). Your use of these services may also be subject to their own terms. We're not responsible for the acts or omissions of these third parties.
Disclaimer of Warranties
The Site and its content are provided "as is." To the fullest extent permitted by law, we make no warranties beyond those that cannot be excluded under the CPA, including as to the Site being uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by South African law, Curvy Waist SA is not liable for indirect, incidental, or consequential loss arising from your use of the Site or our products. This does not limit any liability that cannot lawfully be excluded, including liability for defective goods under the CPA.
Indemnification
You agree to indemnify Curvy Waist SA against claims, losses, or expenses arising from your misuse of the Site or breach of these Terms.
Governing Law & Disputes
These Terms are governed by the laws of South Africa. If you have a complaint, please contact us first at support@curvywaist.co.za so we can try to resolve it directly. You may also refer unresolved consumer complaints to the National Consumer Commission under the CPA.
Changes to These Terms
We may update these Terms from time to time. Changes take effect once posted on this page, with the "Last updated" date revised accordingly. Continued use of the Site after changes means you accept the updated Terms.
